Inheriting property in India as a US citizen

A US passport does not stop you inheriting Indian property. What does cause trouble is missing paperwork — and the single biggest missing document is usually a clear will from the person who owned the property.

What US-based heirs should know

You can inherit

Indian exchange-control rules permit a person resident outside India, including a foreign citizen of Indian origin, to inherit immovable property in India from a person resident in India. Inheritance is treated differently from purchase, which is restricted.

Agricultural land and plantations

NRIs, OCIs and foreign citizens generally cannot purchase agricultural land, farmhouses or plantation property — but they can inherit it. Selling it afterwards may be restricted to a buyer who is an Indian resident.

With a will versus without one

With a valid will, heirs present the will, the death certificate and identity documents to update records. Without one, they must obtain a succession certificate or legal-heir certificate through Indian courts or revenue offices — often taking years when the applicants live overseas.

Transferring title (mutation)

Municipal, revenue or society records must be updated into the heir's name. Requirements vary by state, but expect the death certificate, the will or succession certificate, identity and address proof, and often a No Objection Certificate from other heirs.

Repatriating sale proceeds

Proceeds from inherited property are generally credited to an NRO account, and remittances abroad are subject to annual limits and bank documentation such as Forms 15CA and 15CB certified by a chartered accountant.

Tax considerations

India does not levy an inheritance or estate tax, but capital gains apply when the inherited property is sold, calculated from the original owner's acquisition cost and holding period. US reporting obligations apply separately — take professional advice on both sides.
