Do I need a separate will for my Indian assets?

It is usually the cleanest approach. A will drafted specifically for your Indian property, bank accounts and investments avoids conflicts with a will made in your country of residence and is far easier for an Indian court or bank to act on. Our will is expressly limited to your assets in India so it sits alongside any foreign will.

Is a will made abroad valid in India?

Yes. A will covering Indian assets can be signed outside India, provided it is executed the way Indian law expects: signed by you with the intention of giving effect to the will, in the presence of two witnesses who then attest it in your presence. We give you those instructions with your document.

Does the will need to be registered or on stamp paper?

Accepted Answer

Registration is optional in India and a will does not need stamp paper. Many families still choose to register at a sub-registrar's office for extra evidentiary comfort. Registration is not part of the $50 service.

Who can be a witness?

Accepted Answer

Two adults of sound mind who are not beneficiaries under the will, and ideally not spouses of beneficiaries. A bequest to a witness can be void, so pick neutral people such as colleagues or neighbours.

Sign in, change your answers and re-generate. For twelve months after payment there is no additional charge. After that, a fresh $50 covers another year.
