Registering an NRI will in India

Registration is optional in India — an unregistered will is fully valid. But many NRIs choose to register during a visit home, because an official record makes a later challenge considerably harder.

How registration works

Registration is voluntary

The Registration Act does not make wills compulsorily registrable. A properly signed and witnessed will has full legal effect whether or not it is registered.

Where to register

At the office of a Sub-Registrar. A will may be registered at any sub-registrar office, not only the one where the property is located, which gives you flexibility when visiting India.

Who must attend

You must appear in person along with your two witnesses. A will cannot be registered through a power of attorney, which is why NRIs usually plan it around a trip home.

What to bring

The signed will, your passport and OCI card or Aadhaar, PAN, passport photographs, and identity proof for both witnesses. Take property documents if the registrar asks to verify descriptions.

Cost and time

Registration fees for a will are nominal — typically a few hundred rupees — and no stamp duty applies. The appointment itself usually takes an hour or two.

Simply keep the will unregistered. Sign it before two witnesses abroad, store the original safely, and tell your executor where it is. You can register a later version whenever you next visit India.
